I am filing this complaint regarding Nissan's handling of an open safety recall involving my vehicle and the subsequent engine failure. Nissan issued Recall 26V080 concerning an engine-related defect that can cause engine oil breakdown, bearing damage/seizure, engine damage, and loss of motive power. My vehicle developed the red oil warning light, check-engine light, and reduced engine power before the engine failed. The vehicle also had dark oil and sludge in the engine. The dealership is now attributing the engine failure to alleged lack of maintenance and has denied the engine warranty claim. This is disputed. The vehicle received oil changes at an independent repair facility, and I provided Nissan with receipts documenting the maintenance. The dealership originally relied on the absence of Carfax entries to claim that the oil changes had not occurred. On XXX at approx 1:29 PM, I was driving my 2023 Nissan Rogue (purchased new XXX Chapman Nissan Philadelphia) on [XXX] with my family including 2 young children and my brother-in- law, heading to [XXX]. At highway speed (~65 mph), "Service CVT Power Reduced" warning appeared, complete loss of acceleration. I had to press accelerator to floor to avoid crash. I managed to drive approx 1 mile to emergency stop at [XXX] Fenimore Cooper Service Area, [XXX]. My family with 2 young children was terrified, we had to stop and rest in service area. THIS COULD HAVE CAUSED FATAL CRASH - Trucks behind me at 70 mph, no power, no way to accelerate. If I could not reach service area, we would have been rear-ended at high speed with 2 children in car. This is not just breakdown, this is life-threatening defect. The contact owns a 2023 Nissan Rogue. The contact stated that after the son started the vehicle, white exhaust smoke suddenly emerged from the engine compartment and entered the vehicle's cabin. The engine was turned off, and the vehicle was towed to a dealer. The dealer diagnosed that the engine had sustained a catastrophic failure; however, the cause of the failure had not been determined. The contact was informed that the engine needed to be replaced or rebuilt. The vehicle was not repaired. The manufacturer was notified of the failure, but no assistance was provided. The failure mileage was 98,000.

On 6/22/2026, my vehicle was towed due to loss of power, excessive oil consumption, and excessive vibration, and unable to start. These issues have been ongoing since October 2025. Nissan dealership informed me that I needed a new throttle body and an oil change. Against my better judgement, I paid $1374.02 to replace the part. Two weeks later, My engine started making knocking noises, excessive vibration and completely shut down. Subsequently, I discovered that there is a recall for my vehicle directly related to engine oil bearing failure(NHTSA 26V080, AND Throttle body(NHTSA 26V081). This is an unresolved recall issue and this is both frustrating and disturbing because the manufacture is trying to use delay tactics and avoiding my free repair. This dealer improperly denies a legitimate safety recall when they are required to inspect parts, update software and replace damaged parts at no cost to me. I was told since my warranty has expired, it will not be covered. To say I am baffled...
